Terms of sale
These terms apply to every order you place on this website with Phil's Fencing Supplies Pty Ltd (ABN 58 628 426 899), which runs our Craigieburn warehouse, or ACOM Hoppers Crossing Pty Ltd (ABN 18 682 381 139), which runs our Hoppers Crossing warehouse, both trading as ACOMFENCE ("we", "us"). Your order is with the business that runs the warehouse you order from. By placing an order you agree to these terms. They sit alongside our returns policy, delivery terms and privacy policy, which are linked from the checkout.
1. Who we are
We are a fencing supplier operating from our warehouses at:
Craigieburn: 12 Potter St, Craigieburn VIC 3064. Phone 0437 24 24 24 or email sales@acomfence.com.au.
Hoppers Crossing: 2/1 Desire Pl, Hoppers Crossing VIC 3029. Phone 0451 00 22 44 or email orders@acomfence.com.au.
Our trading hours are shown on the warehouse page of this website.
2. Prices and GST
All prices are in Australian dollars and include GST unless a page says otherwise. Your tax invoice shows the GST amount. Prices and product details are correct when published, but we may correct an obvious error, such as a wrong price or quantity, before we accept your order. If we do, we will contact you and you can confirm the corrected order or cancel it.
3. Placing an order and your quote
When you place an order we email you a quote (an estimate) with an order number. A quote is not a tax invoice, and your order is not confirmed until payment is received. We hold the prices on your quote for 14 days. After that the warehouse may re-quote, because material costs and stock change.
4. Paying for your order
You can pay for an online order by bank transfer or at the warehouse. To pay by bank transfer, use the account details shown on the confirmation page and quote your order number as the transfer reference, so we can match your payment. To pay at the warehouse, bring your order number.
5. When we prepare your goods
We pack goods only against a paid tax invoice. Nothing is held for you, reserved or handed over until payment is received. This does not apply to customers with a credit account with us. The warehouse will contact you on the mobile number or email you gave us when your goods are ready or if we need to confirm something.
6. Collection and delivery
Collection is from the warehouse you ordered from. Whoever holds the paid tax invoice may collect the goods, so keep it safe and only share it with a person you trust. Delivery is available to the areas we list, at the fee shown for your postcode. Delivery is governed by our delivery terms.
7. Checking your goods
Please check your goods when you collect them and tell us straight away about any shortage, damage or error. For delivered orders, please report any issue to us within 24 hours of delivery. Fencing materials are often bulky and heavy, so lift and load them with care.
8. Made to order, cut to length and colour-matched items
Some items are cut to your length, made to order or colour-matched, including Colorbond items. Because we make them for you, we may not be able to accept them back for a change of mind. Colours on a screen can differ from the real product, so please check the colour name on your quote before you pay. Our returns policy explains the details.
9. Title and risk
You do not own the goods until we have received full payment. Risk of loss or damage passes to you when you collect the goods, or when we deliver them to the address you gave us.
10. Cancelling an order
You may ask us to cancel an order before we have prepared it. Once goods are cut, made to order or packed, we may not be able to cancel. Contact the warehouse as soon as you can.
11. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these terms limits those rights.
12. Our responsibility
Subject to your rights under the Australian Consumer Law, we are not liable for loss that was not reasonably foreseeable, or for loss caused by how goods were installed or used, or by site conditions. Please follow the manufacturer's installation instructions and check local council and boundary rules before you build a fence.
13. Your information
We collect and use your details as described in our privacy policy.
14. Changes and contact
We may update these terms from time to time. The terms that apply to your order are the ones shown when you placed it. If you have a question or a complaint, contact the warehouse you ordered from and we will respond as soon as we can.
Craigieburn warehouse: 0437 24 24 24 or sales@acomfence.com.au
Hoppers Crossing warehouse: 0451 00 22 44 or orders@acomfence.com.au
These terms are governed by the law of Victoria, and you agree to the courts of Victoria, without limiting any right you have under the Australian Consumer Law.
